2006 LEGISLATION SPONSORED BY THE VICTIM COMPENSATION AND GOVERNMENT CLAIMS BOARD (VCGCB)
- AB 1921 (Chu), Chapter 46, Statutes of 2006
Appropriates $5,172,769.66 from various funds to the Victim Compensation and Government Claims Board (VCGCB) to pay claims accepted by the Board from April 2005 through November 2005 and authorizes applicable surcharges and fees for these claims. In addition, appropriates $704,700 from the General Fund for the payment of an erroneous conviction claim by John Stoll approved by the Board in May 2006. Also appropriates $1,841,000 from the General Fund to the VCGCB to pay claims resulting from county special elections costs for elections called by the Governor to fill vacancies in the legislature during 2005.

Allows individuals who were living with a homicide victim at the time of the crime to receive reimbursement for home security enhancements and removes the requirement that the qualifying crime must have occurred in the residence where the security is installed; allows reimbursement of the cost of crime scene cleanup when any eligible violent crime occurs in a residence; and creates a pilot program through December 31, 2009, to allow compensation for the loss of childcare services.

2006 LEGISLATION AFFECTING THE VCGCB
- AB 50 (Leno), Chapter 884, Statutes of 2006
Creates funding for the San Francisco Trauma Recovery Center for the 2006-07 fiscal year by appropriating $1.3 million from the Victim Compensation Program’s Restitution Fund.
- AB 105 (Cohn), Chapter 539, Statutes of 2006
Allows the Victim Compensation Program to reimburse more than one relocation for one victim per crime if necessary for the personal safety or emotional well being of the victim, as long as the total reimbursement does not exceed the $2,000 statutory limit.
- AB 1505 (La Suer), Chapter 555, Statutes of 2006
Allows the California Department of Corrections and Rehabilitation to collect restitution from an inmate on behalf of a victim who has not filed an application with the Victim Compensation Program.
- AB 2169 (Montanez) Chapter 475, Statutes of 2006
Extends until January 1, 2013, the Safe at Home Program, which allows victims of domestic violence and stalking to apply for a substitute mailing address designated by the Secretary of State for purposes of public records and service of process.
- AB 2695 (Goldberg), Chapter 476, Statutes of 2006
Extends until January 1, 2010, an additional $200 assessment placed on domestic abusers and the two-thirds share of these funds that are retained by the county to support domestic violence programs. Also authorizes the court, when issuing a temporary restraining order or injunction requested by an employer, to include multiple employees or worksites, and indefinitely extends waivers of process serving fees related to certain protective orders.

Provides that whenever there has been a crime committed against a victim, the law enforcement officer assigned to the case may provide the victim of the crime with a "Victim's Rights Card." Specifies that the use of this card shall be operative in a city or county only upon the adoption of a resolution by the city council or board of supervisors to that effect, and that all provisions in this bill are discretionary.

Allows an individual who pays the funeral and burial expenses for a victim killed by a crime covered under the Victim Compensation Program to be reimbursed, when the victim was a felon, and the individual receiving reimbursement is not a felon. Also allows an individual to be reimbursed for crime scene cleanup expense in cases where the crime victim was a felon, and the individual receiving reimbursement is not a felon.

Appropriates $1,085,100 from the General Fund to the Executive Officer of the California Victim Compensation and Government Claims Board (VCGCB) for the payment of two erroneous conviction claims approved by the Board—$328,200 to Peter Rose and $756,900 to Kenneth Marsh.
