Assembly Bill (AB) 1017, authored by Assembly Member Jackson, Senate Bill (SB), authored by Senator Machado, AB 409, authored by Assembly Member Correa, AB 1003, authored by Senator Frommer, AB 1019, authored by Assembly Member Corbett, and AB 1253, authored by Assembly Member Matthews, were passed and signed by Governor Gray Davis.
- Increased Benefits to Victims of Crime
AB 1017 (Jackson), Chapter 712, expands the definition of derivative victim to include grandparents and grandchildren, allows reimbursement up to $1,000 for crime scene cleanup when a victim dies as a result of a crime, and allows reimbursement for mental health counseling to non-U.S. residents who meet specified conditions for crimes occurring on or after January 1, 2002.
- Increased Benefits to September 11th Victims
SB 551 (Machado), Chapter 346, which took effect upon the Governor's signature on September 25, 2001, remains in effect until January 1, 2004, expands the definition of derivative victim to include California-resident family members of a victim of the September 11th terrorist attacks, whether or not the victim was a resident of California, provides up to $10,000 in mental health counseling benefits for Search and Rescue teams from California who traveled to New York, Washington D.C. or Pennsylvania to help in the aftermath of the terrorist attacks; allows a one-time allocation of $1 million from California's Restitution Fund to New York's victim compensation fund; and authorizes the Board to provide up to $2.75 million to counties to provide group mental health counseling and technical assistance for promotion of tolerance on the basis of national origin.
- Filing Extension Expanded Where Execution or Clemency Hearing Occurs
AB 409 (Correa), Chapter 552, expands circumstances for filing extensions past three years for a victim and derivative victim of a crime who receives notice of an execution or clemency hearing if the victim is re-traumatized under specified circumstances.
- Restitution deducted from inmate civil awards or settlements
AB 1003 (Frommer), Chapter 200, authorizes CDC to deduct restitution orders or fines from specified awards or settlements received by inmates or parolees in civil cases against the State.
- Emergency Awards for Relocation
AB 1019 (Corbett), Chapter 419, provides an emergency cash award to victims of sexual assault to relocate under specified circumstances.
- Psychiatric Mental Health Nursing now covered by the VCP
AB 1253 (Matthews), Chapter 420, adds the specialty of psychiatric mental health nursing, for registered nurses with either a master's degree or an advanced practice clinical nurse specialist certification, to the list of professionals who can be reimbursed by the VCP. This bill included an urgency clause and took effect on October 2, 2001.
